The contract between the Learner and BRAINLify is formed when the Learner accepts these T&Cs, either by explicitly consenting or by accessing and using the services of BRAINLify. By proceeding, the Learner acknowledges that they have read, understood, and accepted the T&Cs.

To create a Personal Account, the Learner must:
To create an account, the Learner must visit the Site and complete all mandatory fields of the registration form. Each Learner is only allowed to create one profile for their account. After completing the registration form, a confirmation email will be sent to the Learner, which will include these General Terms and Conditions of Use (T&Cs). By validating the creation of their account, the Learner acknowledges and accepts these T&Cs.
You must keep your login credentials confidential. We may disable the credentials in case of a breach of the conditions. Suspected breaches require an immediate password change.
The Learner can terminate their registration on the Site at any time by requesting the deletion of their account via the messaging system available on the Site. Furthermore, BRAINLify reserves the right to delete the Learner's account after three years of inactivity.
BRAINLify guarantees that the data collected during account creation is processed securely and in compliance with UK GDPR. Learners have the right to access, rectify, delete, or object to the processing of their personal data as described in the privacy policy and English law.
Only the authorized payment cards detailed on the Site are accepted. The Learner must enter their card number, expiration date, cardholder's name, and any visual cryptogram directly into the designated area.
The transmission of personal information and banking data is fully secured, using an encryption process for the transmission of payment data. This encryption ensures a high level of security for transactions. This information is only accessible to the payment service provider so that they can contact the Learner's bank. Under no circumstances can BRAINLify or any other third party access the Learner's banking data.
In the case of a subscription (monthly or bi-monthly), payment is automatically made by credit card on a monthly or bi-monthly basis (including at the expiration of any Discovery Offer). By paying for a Discovery Offer or subscribing to a monthly or bi-monthly subscription, the Learner authorizes BRAINLify to charge the subscription amount each month until the subscription is canceled.
The charge will be made every month or every 2 weeks using the credit card information provided by the Learner within 48 hours following the initial subscription date.
Subscriptions that renew automatically are disclosed to the Learner in a clear and transparent manner. Straightforward cancellation mechanisms are provided to ensure compliance with UK consumer protection regulations.
The pricing structures and cancellation requirements for the services are as detailed on the Site. Learners are responsible for reviewing and adhering to the cancellation requirements provided. Failure to cancel a Discovery Offer or other subscription within the specified timeframe, as outlined on the Site, will result in the continuation of the subscription, and the Learner will remain liable for all associated payments until cancellation is completed in accordance with the outlined terms. If a price is advertised on the Site for a limited period, then it will revert to full price at the expiration of that limited period and the full amount will be charged against the subscription.
All payments are encrypted to safeguard the Learner's financial information. Payment details are only accessible to the payment service provider and not stored by BRAINLify.
The pricing and subscription details for the services are as set out on the Site. BRAINLify reserves the right to modify pricing, subscription options, or related terms at its sole discretion. Such changes shall become effective upon being updated on the Site.
BRAINLify reserves the right to suspend or terminate the Learner's account and/or access to the Site at any time, without notice, if it suspects a violation of these T&Cs, a breach of applicable regulations, or an activity likely to harm the Site, its users, or its reputation. This termination is at the sole discretion of BRAINLify and may take effect immediately.
Learners can report accessibility challenges by contacting customer support via email. We may update and change our site to reflect changes to our services, users' needs, or business priorities.
We do not guarantee continuous availability. We may suspend, withdraw, or restrict the site with reasonable notice when possible.
BRAINLify endeavours to ensure the Site is accessible 24/7 except during maintenance. BRAINLify will try to communicate any scheduled maintenance in advance.
Learners may terminate their subscription at any time via their account settings. A confirmation page allows Learners to review and finalise their cancellation request. Learners must acknowledge and understand that subscriptions will be taken until terminated. Payments will cease to be taken before the date of the next due payment.
BRAINLify is committed to ensuring that its services comply with all applicable laws and regulations in England and Wales and respect your rights as a Learner. BRAINLify operates in accordance with English law, including but not limited to, consumer protection laws and data protection regulations. Nothing in these terms and conditions affects your statutory rights as a consumer.
BRAINLify is not responsible for any losses or damages suffered by you in connection with the use of the services unless they are caused by its negligence, fraud, or intentional misconduct. For Learners who are private consumers, it will not exclude or limit our liability where it would be illegal to do so, including for death or personal injury resulting from its negligence or for breach of the Learner's statutory rights.
The Site is not designed for professional users, but in the event that professional users access the Site, to the fullest extent permitted by law, BRAINLify's liability to professional users for any claims arising from or in connection with the use of its services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will be limited to direct damages only and will not exceed the subscription price paid by that professional user. BRAINLify excludes any liability for indirect or consequential damages, including loss of profits, business interruption, or loss of data.
BRAINLify is not responsible for the accuracy, reliability, or legality of any third-party publication or user-generated content made available via the Site. This content is provided or created by independent parties and does not reflect the views or policies of BRAINLify. BRAINLify therefore disclaims any liability arising from any reliance on or use of third-party publications, reports, advice, and user-generated content.
BRAINLify will not be liable for any failure or delay in performing its obligations under these T&Cs resulting from events beyond its reasonable control. Such events may include, but are not limited to, acts of God, natural disasters, pandemics, government actions, war, terrorism, strikes, labor disputes, telecommunications or utility failures, or any other unforeseen circumstance. During such events, BRAINLify's obligations under these terms will be suspended for the duration of the disruption.

Learners retain ownership of user-generated content but grant BRAINLify a license to use it for service-related purposes. BRAINLify ensures that this content is protected and managed appropriately.

These T&Cs and any non-contractual obligation arising from or in connection with them or the Site are governed by and interpreted in accordance with the laws of England and Wales. All parties irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these T&Cs or the Site or their subject matter or formation.
